While Israel continues to starve and bomb Gaza, Germany’s political elite celebrated 60 years of diplomatic relations with Israel this week.

There was talk of “historical responsibility,” of “community of values,” of deeper cooperation, culturally, scientifically, and militarily.

@JoWadephul @AussenMinDE couldn’t have made it clearer right at the beginning of his term what to expect from the new federal government – ​​a German Middle East policy that continues to be completely detached from human rights and international law.

The coalition agreement negotiated by the CDU, CSU, and SPD in April also makes this clear:

The relevant section on page 127 begins with the usual commitment to Israel’s right to exist.
However, the right to exist belongs to individuals and peoples, not states.

As a UN member state, Israel possesses all the rights and responsibilities of a sovereign state, even if Israel doesn’t want to admit this. #ICC #ICJ

What’s missing: recognition of the rights of the Palestinians. They, like Israelis, have an inalienable right to life, security, justice, and dignity.

The ICJ rulings in the South Africa v. Israel case are not mentioned, nor is the ICJ Advisory Opinion of July 2024: Israel’s entire occupation is illegal, it violates the Palestinians’ right to self-determination and violates the prohibition of apartheid.

The new German government, it seems, also wants to cling to the ideal that Israel is “the only democracy in the Middle East.”

Even after 18+ months of genocide, the coalition agreement presents Israel’s actions in Gaza as legitimate “self-defense” to “ensure its own security.”

The term is also legally incorrect. Gaza is not a sovereign state, but is illegally occupied by Israel (see the ICJ opinion of July 2024).

Because the new federal government refuses to confront the reality – the genocide – it is also evading its legal obligation to take concrete action.

Germany will therefore continue to fail to fulfil its obligation to stop the genocide.

Während Israel weiterhin Gaza aushungert und bombardiert, feierte Deutschlands politische Elite diese Woche 60 Jahre diplomatische Beziehungen mit Israel.

Es war die Rede von „historischer Verantwortung“, von „Wertegemeinschaft“, von vertiefter Zusammenarbeit, kulturell, wissenschaftlich und militärisch.

Deutlicher hätte @JoWadephul @AussenMinDE direkt zu Beginn seiner Amtszeit nicht zeigen können, was von der neuen Bundesregierung zu erwarten ist – eine weiterhin von den Menschenrechten und vom Völkerrecht völlig losgelöste deutsche Nahostpolitik.

Das macht auch der von der CDU, CSU und SPD im April ausgehandelte Koalitionsvertrag deutlich:

So beginnt der relevante Abschnitt auf S. 127 mit dem üblichen Bekenntnis zum Existenzrecht Israels.
Allerdings: Das Existenzrecht kommt Menschen und Völkern zu, nicht Staaten.

Israel besitzt als UN-Mitgliedstaat alle Rechte und Pflichten eines souveränen Staates, auch wenn Israel dies nicht wahrhaben will. #ICC #ICJ

Was fehlt: die Anerkennung der Rechte der Palästinenser. Sie besitzen, wie Israelis, ein unveräußerliches Recht auf Leben, Sicherheit, Gerechtigkeit und Würde.

Die IGH-Entscheidungen im Fall Südafrika vs. Israel werden nicht erwähnt, ebenso nicht das IGH-Gutachten vom Juli 2024: Israels gesamte Besatzung ist rechtswidrig, es verletzt das Selbstbestimmungsrecht der Palästinenser + verstößt gegen das Verbot der Apartheid.

Auch die neue Bundesregierung, so scheint es, will am Wunschbild festhalten, Israel sei „die einzige Demokratie im Nahen Osten“.

Der Koalitionsvertrag stellt auch nach 18+ Monaten Genozid Israels Vorgehen in Gaza als legitime „Selbstverteidigung“ zur „Gewährleistung der eigenen Sicherheit“ dar.

Der Begriff ist auch juristisch falsch. Gaza ist kein souveräner Staat, sondern von Israel rechtswidrig besetzt (s. IGH-Gutachten vom Juli 2024).

Da sich die neue Bundesregierung nicht mit der Realität – dem Genozid – auseinandersetzen will, entzieht sie sich auch der rechtlichen Verpflichtung zu konkretem Handeln.

Deutschland wird also weiterhin nicht seiner Verpflichtung nachkommen, den Genozid zu stoppen.
